Separation and divorce

Either spouse may apply for legal separation, even if the other spouse does not agree. If both spouses agree to divorce, they may apply after at least six months from the separation date stated in the separation permit or court judgment. If one spouse does not agree, either spouse has the right to divorce after at least one year of separation. If the spouses disagree about the divorce or possible terms for spousal maintenance, the Family Law Administration cannot authorise the divorce; it can be granted only by a judgment of the Court of the Faroe Islands.
